Terms & Conditions & Consent Notice

Welcome to the Left Write Hook Trauma-Informed Peer Writing and Boxing Coaching professional development certificate course (“Course”). Before you begin, please read the following Terms & Conditions, which outline how you can use the course materials, how your data may be used, and your rights regarding privacy and consent.

By enrolling in the Course, you agree to the terms outlined below.  These terms constitute a legally binding agreement between you and Left Write Hook Limited ACN 664 485 134 (Left Write Hook/ we/ us).

1. Copyright Notice

All content provided in the Course, including but not limited to course materials,  text, graphics, logos, images, and software (together the Course Content), is the property of Left Write Hook and/or its licensors, and is protected by copyright and other intellectual property laws.  

In enrolling in the Course, you are granted a non-exclusive, non-transferable, revocable license to access and use the Course Content for the following purposes: .

Apart from the forgoing licence rights, all rights in and to the Course Content are strictly reserved by Left Write Hook.  You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our site or other Course Content , except as follows:

The licence granted by this document in relation to the Course Content only applies to the version of the Course Content we make available to you, and to no other version.  You agree that we may alter the Course Content at any time with or without notice to you. 

You may use the most recent version of the Course Content that we deliver to you under this licence in perpetuity for any materials that are expressly provided to you for offline access or download (e.g. PDF guides or facilitator notes), subject to the conditions outlined in this agreement and unless your licence is revoked due to breach of terms.

For online materials or portal-based access, your licence to use the Course Content applies only while you have active access to the course platform. We may terminate, suspend, or restrict this access at any time without prior notice.

Successful completion of the Course does not provide any form of accreditation or certification.

You may not make any representations about any association with Left Write Hook or use any intellectual property of Left Write Hook or its licensors, other than as licensed in this document, without express written permission from the copyright owner.

4. Enrolment and Personal Information

To enroll in the Course, you must complete the registration process, providing accurate and complete information as prompted by the registration form.

Failure to provide accurate and complete information in enrolling in the Course constitutes a breach of these terms, which may result in your removal from the Course.

You are responsible for safeguarding the password that you use to access the Course and for any activities or actions conducted using your password.

You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account or access to the Course.

Left Write Hook will manage your personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

By enrolling in the Course, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

5. Disclaimer of Warranties and liability limitation

The Course is provided on an "as is" and "as available" basis. Apart from warranties implied by law which are not capable of exclusion, Left Write Hook makes no representations or warranties of any kind, express or implied, as to the operation of the Course or the information, content, materials, or products included in the Course.

You agree that by participating in the Course that Left Write Hook’s liability in relation to the Course, in relation to any breach of this document, or for negligence, is limited to the amount you pay to participate in the Course, and if no payment is made, to an aggregate amount of AUD $10.  

To the extent that we have any liability to you in relation to a breach of the consumer guarantees in the Australian Consumer Law in relation to the supply of the Course or Course content, then you agree that we may limit our liability to either, at Left Write Hook’s discretion, the supply of the relevant Course or Course Content again, a refund of the relevant fees paid by you for the Course or Course Content, or the payment of the cost of having the Course or Course content supplied again.

You agree that Left Write Hook will not be liable for any consequential, collateral, special, incidental, indirect, exemplary or punitive damages, including, without limitation, loss of profits or revenue, loss of opportunity or loss or destruction of data, costs of cover, costs of delay, however caused and based on any theory of liability, for any claims or causes of action arising out of or related to this document, the Course or Course Content.     

6. Acknowledgement of Terms

Before accessing the Course, you will be required to acknowledge that:

This Course is part of a research study supported by the Medical Research Future Fund (MRFF). As such, we may collect feedback, reflections, and responses from your Course participation. Please note:

Without limiting our rights in this document, we may terminate or suspend your access to the Course and Course Content immediately, without prior notice or liability, if you breach these terms.

Upon termination, your right to access and use the Course and the Course Content will immediately cease.  You must delete or destroy all copies of the Course Content in your possession following termination. 

If you wish to terminate your account, you may simply discontinue your participation in the Course.

All provisions of these terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with those matters.

10. Indemnification

As a condition of your access to and use of the Course, you agree to indemnify us and our successors and assigns for all damages, costs, expenses and other liabilities, including but not limited to legal fees and expenses, relating to any claim arising out of or related to your access to and use of the Course Content or your breach of these terms.    

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision of these terms is material we will try to provide at least 30 days’ notice prior to any new terms taking effect.

It is your sole responsibility to periodically check these terms for any changes. If you do not agree with any of the changes to these terms, it is your sole responsibility to stop accessing the Course and the Course Content. Your continued access to the Course and Course Content will be deemed to be your acceptance of the terms (as modified from time to time).
